Debt Collectors claiming great victory????

ACA Claims First Major Regulatory and Legislative Victories of 2005

MINNEAPOLIS - Two major developments in Washington, D.C., this week are being hailed as victories for both consumers and the credit and collection industry, according to ACA International (ACA), the Association of Credit and Collection Professionals.

“The actions taken by Congress and the Federal Communications Commission (FCC) yesterday will advance the interests of American consumers by reducing the abuse of the legal system through frivolous lawsuits and by affirming consumer privacy,” said ACA General Counsel Rozanne Andersen.

On Thursday, the FCC responded to ACA’s August 2003 petition for reconsideration of the Telephone Consumer Protection Act (TCPA). ACA has worked closely with the FCC to clarify measures of the TCPA that create unworkable contradictions with the Fair Debt Collection Practices Act (FDCPA).

<> Under the FDCPA, a powerful consumer protection law, collectors are not allowed to disclose a consumer’s past-due debt to anyone other than the debtor in the interest of consumer privacy. The troublesome measures of the TCPA would have required collectors to identify the state-registered name of their business in any pre-recorded telephone messages to consumers. Since the name of many collection agencies indicates that the call is being made for the purpose of debt collection, ACA argued that requiring the agency to declare its company name before verifying that it has contacted the correct party constituted a violation of the FDCPA.

And that is supposed to be some "major victory"??? That just keeps savvy consumers from hitting them with yet another violation of law and filing lawsuits on them. Of course, if you are a debt collector anything you can do to keep from getting skinned alive by CREDITWRENCH educated consumers is a big feather in your cap. But it sure didn't give them any new powers.


Also on Thursday, by an overwhelming majority of 72-26, the U.S. Senate approved a bill to reform class action litigation. Class action reform has been on the association’s legislative agenda for two years, and has now cleared its first hurdle in the effort to reduce the number of frivolous lawsuits filed against companies, including ACA members.

Frivolous law suits? Well, as always what is frivolous just depends on whose ox is getting gored. These debt collectors are so worried about Cover Your A$$ problems that they are about to go out of their everlovin minds. All they would have to do is behave, obey the law and they wouldn't have to worry about class action or any other kinds of lawsuits, frivolous or otherwise. Debt collectors never learn. They are all "UNCLE NORMIES" in that they are always trying to pick on somebody else but are entirely too stupid to figure out what to do next.

"Uncle Normie", the great braying jackass spammed all the newsgroups the other day and all that did was promote the newsgroups to the search engines but in order to keep his publicity he will have to do as he promised and spam them all every day with a new message. Of course, he wasn't smart enough to get a free ffa blaster program and send his spam to all the FFA pages and classified ads pages. He can do that for free and all he has to do is just keep on spamming the newsgroups and blasting to the FFA pages and then there is a great linking program he can use called ZEUS but he isn't smart enough to use that either.
