Do you offer a standard validation letter that is appropriate to send them?&lt;br /&gt;Thanks in advance.&lt;br /&gt; &lt;br /&gt;Answer:&lt;br /&gt;&lt;br /&gt;Yes, I go through all of that in one of the links above and yes, I realize that there is a mountain of reading to do in those links so I will answer your question directly.&lt;br /&gt;&lt;br /&gt;First of all, yes, as part of your creditwrench course you do get a standard validation template you can use but it will have to be modified just a tiny bit each time you use it. But that isn't all.&lt;br /&gt;&lt;br /&gt;Obviously you can get any number of validation letters from multitudes of web sites all over the net but the creditwrench validation letter is very, very different and mostly because it does not use a lot of useless and irrelevant nonsense and legalese that is to be found in most validation letters.&lt;br /&gt;&lt;br /&gt;And you can also obtain what is known as an estoppel letter from a multitude of web sites on the net. You get one of those as well as part of your course.&lt;br /&gt;&lt;br /&gt;From there all resemblance of what you can find on the net for free stops and creditwrench comes to the forefront with a series of continued letters ending in an intent to sue letter which is fully legal in format and the case is ready to file in federal court at that point. In other words once you use the full series you will understand exactly how to file a case in federal court.&lt;br /&gt;&lt;br /&gt;In some instances it is not advisable to use the entire sequence. One example is when you have already been served a summons to court or you are going to try to get a judgment vacated. Under those circumstances it is not practical to use the entire series. You will be taught when to use the full series and when not to.&lt;br /&gt;&lt;br /&gt;But that is only a very small part of what you will learn as you proceed through your problems.&lt;br /&gt;&lt;br /&gt;You will also be taught various defense and offense mechanisms and how to use them and when to use them.&lt;br /&gt;&lt;br /&gt;You also get access to our creditwrench student's lounge which is a password protected section of our message board which you already know about. I like the responses to some of the more complexed questions, so here is my question: Recently i received a summons to go to court from a company named Calvary Portfolio Services, LLC.  The attorney's name is Anne Thomas affiliated with Thomas Law Offices, PLLC. On this summons, the return address is really the address of Cavalry Portfolio Services, LLC but it is being listed as the address of Thomas Law Offices, PLLC! Portions of the address is omitted and my guess is that the name of Calvary Portfolio Services, LLC is not shown for a reason. Anyway, not only the concern about the return address, they filed an outdated legal document, the wrong address for the court, the wrong name as the court clerk and i thought that they could not file anything with the courts until all of the return service (green cards) were received back from the respondents (debtor). Secondly, i found out that my 14-year-old son signed for the certified letter they sent to me regarding this summons. I thought that in order for this service to be effected, the signer would have to be 18 years or older.  This summons lacks the CIS# that goes along with the packet, so much is missing from this document. It has the revised date of 09/2002 but looking online the revised date of the official new documents is 2008. I really think that this is a bogus case but i am not sure,I thought about using this as a defense along with the fact that the debt they are coming after me is well over 18 years old and was under a Bankruptcy that was filed and discharged under a Chapter 7 in the 1990's! I know that i typed a lot but i tried to sum things up all in one questionairre. Also, i found out that this company has been doing this to others as well. Can they purchase an old, old debt like this one and get away with it, wasting my time and the court's time?&lt;br /&gt;&lt;br /&gt;Answer:  They are not wasting your time nor the court's time if you don't respond to the summons and complaint in a proper manner because they will get a judgment and then you will have lost your opportunity to plead the defenses you have available to you.&lt;br /&gt;&lt;br /&gt;How do you know that they have the wrong address for the court and the wrong name as the court clerk? Maybe they filed in the wrong court? The correct court would be the court system in your county. Maybe they filed in a different county or state? I would strongly suggest that you check with the clerk of the court in both courts and see whether a case has been filed against you in either one. If so you will have to respond to the summons no matter what court it has been filed in. If they filed in the wrong court you will have to inform the court that they don't have jurisdiction and state what state and county you live in. You may have to prove where you live with copies of utility bills or your driver's license or something official.&lt;br /&gt;&lt;br /&gt;When you get it into the proper court you can then start to defend and of course the best defense is a strong offense. I would also recommend that you speak to the judge or referee of the bankruptcy court where you filed bankruptcy to see if that court can be of some help to you. I know little or nothing about bankruptcy but it seems to me that I have read somewhere that attempting to collect a debt discharged in bankruptcy constitutes a contempt of court. Don't bother going to the attorney who filed your case because he probably won't want to do anything unless you pay him again.&lt;br /&gt;&lt;br /&gt;This appears to me to be a case that is ripe for a federal case against the debt collector and the attorney who filed it for a multitude of violations. Why not file a federal case against them and make them pay you for your time and trouble to defend. This case ought to be worth several thousand dollars in your pocket. Don't be frightened about filing a federal case. It simply isn't hard to do and it certainly don't need a lawyer to do it for you. This was from a collection agency being represented by a law firm. There isn't a court date on this summons. There is only a statement saying I have 14 days to respond with my answer. I did call the small claims court clerk and was told that a court date would be set after they received my answer if I was denying responsibility of this debt.&lt;br /&gt;&lt;br /&gt;My problem is that I don't know exactly what this debt is about. I do have a couple of unpaid credit cards from the past and this matter more than likely relates to one of them, but I don't know which one it would be. I don't recognize the dollar amount being asked for; but I am well aware the original amount could have easily doubled by interest fees, etc. My question is on what to say in my answer.&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Why answser at all? Respond to the summons instead with a demand for more definitive statements. How do I go about getting the information about exactly what this lawsuit is about?&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;You simply state in your demand for more definitive statements that you have no idea what this matter is about and demand that they inform you who it is that you allegedly owe the debt to.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;When I send the defendants lawyer my answer to the summons, do I ask him in that letter? Or do I send him a copy of the summons answer that I file with the court and send him an additional letter asking for more information about this.&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;You must send the plaintiff's lawyer a copy of anything you file with the court by certified mail return receipt requested.  Don't send him anything you didn't file in court unless you are demading interrogatories, admissions and production of documents. Those are never filed in court. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;Also, Ive read something about discovery and it starts after I've filed my answer to this complaint. Is this something I initiate on my own, or do I have to file something with the courts to do this?&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;There are 5 discovery tools  at your disposal.  The first is known as interrogatories, the second is known as demand for admissions, the third is known as demand for production of documents, depositions and Subpoenas such as Subpoena Duces Tecum and other court orders. I have no idea how to fight this and all of them total up to a very big sum. The interest alone os over $700. I am a city police officer and the only source of income in my household. My pay amount is decent but the cost of living here is atrocious!!!! Everything that I make is sucked up by the cost of living. I make roughly $1400. every two weeks, but my rent is 1050, car payment(on the only car we have, the other was repossessed) is $454, insurance is $80,  phone bills at least $150, gas (we won't even go there)electricity is $190 or so, food is probably $400-500 (I have a four, five, and six year old)....I mean I can't afford to pay attention!&lt;br /&gt;&lt;br /&gt;All of the deliquent accounts are from 2005, 2006 and 2007. I have told the collection agency that I will start a second job in Spring to pay, but they went ahead and filed with a local attorney. I can't pay, I can't afford garnishment, I can't do this! I was just about to file bankruptcy next month which will be too close to the court date won't it? Please help!!!&lt;br /&gt; &lt;br /&gt;Answer:  If you are a law enforcement officer you recognize that two wrongs don't make a right. Example. If I am stopped for an traffic offense and I am respectful and cooperative with the officer, have no weapons, drugs, liquor or anything illegal in my possession but the officer beats me up Rodney King style because he is angry for whatever reason, can he be sued for his wrongful acts against me? Of course he can be sued. It is the same in the world of debtors. You may owe money but does that give them the right to violate your rights under the law? No, it does not, but they do it routinely and with impunity because few people will ever sue them for their violations of law. Attorneys violate the law in the process of debt collection all the time. They lie to the courts routinely and get away with it in local courts. Local court judges go along with it and say nothing. They care not one whit for debtors such as yourself or their rights. The only thing they care about is getting justice for the creditor and their attorney and nothing at all about the rights of the citizen before them. The citizen can demand to have an accounting of the amounts claimed and the judges just deny it and give judgment to the plaintiff even though the law plainly states that if a debtor demands an accounting it must be provided to him. Debtors can dispute the jurisdiction of the court and even if it is plain that the court does not have proper jurisdiction to hear the case and the defendant disputes jurisdiction the courts deny such allegations and move on to judgment. That in spite of the fact that the United States Supreme Court has ruled on many occasions that if jurisdiction is challenged all further action must be stopped until that issue is resolved. You will not get justice in the court proceedings you are faced with any more than citizens do in local traffic courts. As an officer in court you are always right and the defendant hasn't got a crying chance. It is the same in the court you are now faced with. The attorney is an officer of the court and you are nobody. But there is a way to get justice and that way is to sue the attorney for his illegal acts in U.S. Federal District court where the only question before the court is whether or not they broke the law. The fact that you owe money matters not. I can guarantee you that the attorney and the plaintiff have broken the laws in several ways. So what are you going to do? Are you going to stand still for having your rights under the law ignored and stomped on or are you going to fight back and make them obey the law just like they expect you to do? I know the statutes for collection in my state, however it has four  different kinds of dept listed-oral, written, open ended, and promissory note.   However I do not know what kind of bill a phone bill is considered.  I do not  believe that this bill is mine, but it would be a lot easier to get cleared if  it is too late to collect. The company provides the service then bills you for it at the end of  each month or billing period. So the same statute of limitations would apply. I  fail to understand why you think it will be any easier to get cleared if it is  too late to collect. Debt collectors often demand payment on debts that are more  than 20 years old no matter what the statute of limitations might be. They rely  on the fact that most people don't know about such things as statutes of  limitations and will often pay the bill whether they owe it or not just to keep  themselves out of trouble. If they know about the statute of limitations they  often ignore the debt collector because they think that the debt collector can't  collect it. They often learn the hard way that if the debt collector files a  lawsuit and they don't defend by filing a proper response to the complaint the  statute of limitations means nothing and they will get a judgment. They also  rely on the fact that finding competent legal help at a reasonable price is not  an easy thing to do. The lawyer costs more than just paying the debt in many  cases. The debt collector gets paid on out of Stat debt so often that it is very  profitable to buy those old debts for pennies and go for the entire amount.  Folks need to learn how to deal with abusive debt collection practices like that  and do it without having to resort to lawyers or credit repair organizations. It  just isn't all that difficult. The first step is learning how to combat the  phone calls. Make the lawyer explain and prove each and every little thing he says in his complaint. If he says his plaintiff is duly authorized to do business in your state make him explain who authorized his plaintiff to do business in your state. By what authority do they do business in your state?&lt;br /&gt;&lt;br /&gt;If he names First USA Bank N.A. as being the plaintiff (for instance) go to google and type in &lt;a href="http://www.occ.treas.gov/"&gt;OCC&lt;/a&gt; and hit search button. That will take you to the office of the comptroller of the Currency which is a government agency of the United States Treasury. Look in the right hand column and you will see lists of all of the banks authorized by the United States Treasury to do business as Nationally Accredited banks hence the letters N.A. and you just might be surprised to learn that First USA Bank is not even listed there, much less being a N.A. bank.&lt;br /&gt;&lt;br /&gt;So if that is the case for the plaintiff in your case then make the lawyer explain what N.A. means and prove that the plaintiff is not a nationally accredited bank as he has claimed.&lt;br /&gt;&lt;br /&gt;If he says that the court has jurisdiction and venue make him explain what those terms mean and by what authority does the court have jurisdiction and venue. There are multiple forms of jurisdiction. Make him tell you whether he means geographical jurisdiction, subject matter jurisdiction, IN PERSONAM jurisdiction or exact which types of jurisdiction the court has and how it got jurisdictions. His simple statement that the court has jurisdiction don't cut no ice.&lt;br /&gt;&lt;br /&gt;If he talks about Quantum Meriute then make him explain what that is and how it applies to you. If he talks about ACCOUNT STATED or UNJUST ENRICHMENT make him explain those terms to you because you are so stupid you don't understand a single thing he claims and you wouldn't admit it if you did.&lt;br /&gt;&lt;br /&gt;You can't file a motion for a more definitive statement in some states but you can demand a Bill of Particulars in those states and so you simply call your motion for more definitive statements a Bill of Particulars instead of a motion for more definitive statements. Same thing, really, and either way it serves as your response to the summons and complaint even if the judge won't let you do it. Most judges will allow it.&lt;br /&gt;&lt;br /&gt;And of course the lawyer will object to that in many instances, so if he files an objection you will have to answer his objection and state why you don't understand all his legal nonsense. As an unsophisticated consumer you have the legal right to demand those explanations in order to properly prepare your defense.&lt;br /&gt;&lt;br /&gt;If he still don't answer all your questions then you file motion to deem admitted. You have that right because the court obviously ordered the plaintiff to answer so if they don't they are actually in contempt of court and can't use any of those terms or statements in their prosecution of the case. So if they can't use any of those words, terms or phrases what have they got left? Nothing at all.&lt;br /&gt;&lt;br /&gt;Then send them a demand for production of documents and if they don't respond then you can file motion to compel or subpoena Duces Tecum, either one. Then when they do answer your demands you probably will either have grounds to dismiss or you might be able to use them to craft your interrogatories and demand for admissions. More ammo to use against them.&lt;br /&gt;&lt;br /&gt;Then get ready for the real fun by taking them to federal court for violations of FDCPA and FCRA and that's when the rubber really meets the road. Once you get them there it is no longer a question of whether or not you owe them money bur rather only why they broke the law and if you are right and you have the proof of their wrong doing and you get to the Rule 26(f) meeting and you explain to them what they did wrong and show your proof they suddenly get religion and they don't want to go to a full blown trial at any price.&lt;br /&gt;&lt;br /&gt;They will probably only want to know what it is going to take to make you go away. Of course, the price is going to start off with dismissal of their lower court suit, promise in writing to never reveal the terms of the settlement agreement to any third party for any reason whatever, never sell or assign the debt to any other party, pay your court costs and your attorney fees (federal courts have now ruled that even as a pro se they must pay you reasonable attorney fees and judges who refuse to award you attorney fees will be reversed on appeal) and remove any and all derogatory remarks from your credit reports.&lt;br /&gt;&lt;br /&gt;They don't want to agree to those terms? Ok Pal, we will let the judge and jury decide what happens and believe me, they don't want to go there. Intent ot Defend is likely a jurisdictional term for answering the complaint. Without an answer, the plaintiff can go for a default judgement.&lt;br /&gt;&lt;br /&gt;Cap1sucks is talking about discovery, a very separate part of the court process and dictated by the Court's rules of procedure.&lt;br /&gt;&lt;br /&gt;Original Poster needs to answer the complaint and add any affirmative defenses that he might have. He can then move on to discovery.&lt;br /&gt;&lt;br /&gt;As much as Cap1sucks would like to have the procedure meet his view, the Courts have the power to define how they work. Now, my bet is that this jurisdiction follows the notice pleading rules of procedure but, moving for particulars (sorry, VA Procedure kicking in) is an excellent procedural move which, naturally, comes before an Answer.&lt;br /&gt;&lt;br /&gt;If this is debt purchaser, they usually never respond. If an Original Creditor, they probably will object citing notice pleading yada yada yada. Just oppose the objection and the judge will defer to the self-represented litigant.&lt;br /&gt;&lt;br /&gt;However, a Motion for a More Definitive Statement is not in the province of the discovery process. It is not interrogatories, admission, requests, inspections, etc. It is filed pre-Answer, Motion To Dismiss, JMOL or whatever you choose as a responsive pleading. If there is no contract, simply file a Motion to Dismiss because the Plaintiff has requested relief which cannot be granted. In other words, they have no evidence without a contract. They may have an affadivit instead. If that is all, call the judge's chambers and set a trial date or wait for it if already set. While one can do just as you have suggested it is not practical to do so in most lower courts for the simple reason that the only question before the court is whether or not the debtor owes the debt and that is the only thing the court is usually interested in hearing about. Anything else will be totally ignored or ruled against. What they might have done to the defendant has absolutely no bearing on whether or not the debtor owes the debt. As &lt;a href="http://www.creditwrench.com/"&gt;Bill Bauer teaches,&lt;/a&gt; the answer is to file in federal court for their violations of FDCPA and not try to use it against a plaintiff's demand for payment via judgment proceedings.&lt;br /&gt;&lt;br /&gt;In federal court it makes absolutely no difference whether the plaintiff owes the defendant money or whether the defendant has a judgment against the plaintiff or any of that. The only question before the federal court is whether or not the defendant broke the law.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://consumers.creditwrench.com/" bill=""&gt;&lt;/a&gt; is currently heavily involved with beating arbitration cases and seems to be making some headway. One of his students in Missouri filed a motion for injunctive relief against arbitration and NAF had an attorney put in an appearance objecting to the motion for injunctive relief but that attorney cannot put in an appearance for NAF in the case for the simple reason that no arbitrator can be sued nor can they appear in any court case. They are totally immune from any court action against them. So their attorney has no right to appear in any court of law to object to the plaintiff's motion for injunctive relief in the Missouri court. So the next move seems to be to put in a motion in limine to exclude anything the NAF attorney might say. According to both federal and Missouri state law NAF can neither be sued nor can the make any appearance in any court of law on their own behalf.&lt;br /&gt;&lt;br /&gt;The way I found out about all this was by listening in on his Friday night conference call last night. Bill didn't say much but just let everybody else do all the talking. The call started at 7:00 P.M. and lasted until after midnight as they usually do. I live in texas and are wondering what should i do..can they put a judgement on my home and also I have gas royalties paid to me monthly can they attach to that or my bank accounts or garnish my wages? is there any forms i can fill out to delay any of this? do I avoid the constable? i do have credit card debt i think in the ammount of 30 to 40,000 dollars and i did try and negotiate payment with them yrs ago due to unemployment but they wouldnt work with me and im sure now it has racked up. so what are my options and where do i find forms, and how do i find out where to send them .I do figure it is Asset Acceptance or something like that i did call them a few months ago about a charge that wasnt mine and they brought up alot of other stuff as well and well talked very ugly to me so i hung up..I have alot of bills and alot of health things going on which take my money for insulin and so forth and i know there are ways to do something with out filing bankrupsy...you seem very intellegent and informative and any info you can provide would be so helpfull..&lt;br /&gt;&lt;br /&gt;thanks&lt;br /&gt;&lt;br /&gt;kita&lt;br /&gt;&lt;br /&gt;Answer: I'm pretty sure you called me on the phone this afternoon and we discussed this entire matter but I'll answer anyway.&lt;br /&gt;&lt;br /&gt;I do appreciate your calling me. Can they take your oil and gas royalties? They can attach those if they find out you are getting them and yes, they can eventually force you to tell them about that in a garnishment hearing. If your home is homesteaded in Texas then it should be safe from liens. Do you avoid the constable? That's up to you but I sure wouldn't bake him a cake and invite him in. If he catches you in then you might as well take the summons. They will nail it on you one way or another sooner or later but in the meantime you might as well get all the time you can until they do hang it on you. Bankruptcy is a very poor thing to do. As a matter of fact, the new bankruptcy law has made it so much harder to file bk now that large numbers of people are simply walking away from their mortgages rather than filing BK and that is beginning to bite back by drastically adding to the home foreclosure problems the nation is already having. If they had left the BK laws alone and let people include their mortgages in bankruptcy and end up keeping their homes that would not have happened. The system wasn't really broke and they tried to fix it anyway and now it is coming back to haunt them in ways they never dreamed would happen.&lt;br /&gt;&lt;br /&gt;And it could not have happened at a worse time for our economy. Bankruptcy never was a good option anyway. Creditwrench methods work in such a way that the same thing is accomplished with a lot lower price tag and is much better because it leaves on bad marks on your credit reports. Bauer&lt;/h1&gt;&lt;p&gt;&lt;/p&gt;&lt;p&gt;The plaintiffs in Callier vs. Bauer, a federal court case in El Paso Texas lost their case when they could not prove their allegations.&lt;/p&gt;&lt;p&gt;Since they could not prove their case they have obviously filed a malicious lawsuit against Creditwrench CEO Bill Bauer.&lt;/p&gt;&lt;p&gt;How can we know that such is the case? That's easy. Here are the requirements to prove a case of malicious prosecution.&lt;/p&gt;&lt;p&gt; The elements of a malicious prosecution case are (1) that the defendant filed and/or prosecuted the underlying civil action; (2) a favorable termination of the prior case, in which the innocence of the former defendant was established; (3) the absence of probable cause, meaning that no reasonable attorney would have considered it to be tenable; (4) malice, which can be implied from a conscious disregard for the consequences, from a lack of probable cause, and from inadequate investigation and research, and (5) damages.&lt;/p&gt;&lt;p&gt;Obviously it will not be difficult to prove that the defendant filed and or prosecuted the underlying civil action.&lt;/p&gt;&lt;p&gt;And it will not be difficult to prove that the termination of the prior case in which the innocence of the former defendant, Billie Bauer was established when the plaintiff(s) could not prove their case and had to let it be dismissed by the court for lack of proof of their complaints.&lt;/p&gt;&lt;p&gt;The third element of proof is that there was no probable cause meaning that no resonable attorney would have considered it to be tenable and &lt;/p&gt;&lt;p&gt;Malice, which can be implied from a conscious disregard for the consequences, from a lack of probable cause and from inadequate investigation and research and &lt;/p&gt;&lt;p&gt; of course the damages. The Plaintiff in the new case soon to be filed in the Western District Federal Court in Oklahoma City, Oklahoma will probably ask for and demand unlimited damages.&lt;/p&gt;&lt;p&gt;The first case will be filed against Ana Callier for her attempt to claim that Creditwrench CEO Billie Bauer had stalked her under 18 U.S.C. 2261(a). Since there had never been any contact of any kind whatever with the defendant by the new plaintiff, Ana Callier could not possibly have proven her case and the Judge in the previous case obviously knew that. The court's major reason for dismissing the case presented by Ana Callier was that the charge of stalking under 18 U.S.C. 2261(a) is a criminal complaint and can only be brought by a U.S. Prosecutor thereby fullfilling the third element of malicious prosecution.&lt;/p&gt;&lt;p&gt;On Thursday, June 21, 2007 the author of the blog known as angryconsumer.blogspot.com wrote the following, to wit:&lt;/p&gt;&lt;p&gt;Yup, that's right, Billie we've had enough of your stuff, and you've been sued. It was filed yesterday, and you should get your invitation around 10AM to the party we are having in his honor in court. Come on down, bring a friend, and we can all get to know each other really well in court.&lt;/p&gt;&lt;p&gt;&lt;/p&gt;If someone has such a burning desire to meet me in a federal court their hearfelt desire should not be denied. To do so would indeed be a shame and so in order that they might have their burning desire fullfilled we will give them that opportunity to do so by inviting them to come to Oklahoma City for that special purpose. Our first invitation will be directed to Ana Callier. I'm sure that lady would just love to come to Oklahoma City to defend a case of malicious prosecution against her for unlimited damages.&lt;p&gt;&lt;/p&gt;&lt;p&gt;Of course, since I am well aware that such a trip will be a bit expensive for her I will give her the courtesy of reducing the costs of such a trip in the following manner. &lt;/p&gt;&lt;p&gt;Notice of Lawsuit and Request for Waiver of Service of Summons&lt;br /&gt;TO:Ana  L. Her comment in doing so was that 18 U.S.C. 2261A is a criminal statute and must be brought by a U.S. Prosector as a criminal charge. She said that private parties cannot bring criminal complaints against anyone. Then she also dismissed their state claim also based on the same theory. Then she gave them until August 10th to prove the rest of their claims and the actual damages which they claim resulted. Most of them were filed in forma pauperous and were either dismissed by Cunningham or his application to file in forma pauperous was denied by the court and the case dismissed. Normisly Stupid idea that one should challenge the jurisdiction of the Western District of Texas in El Paso in the ongoing case of the plaintiffs Cunningham, Callier and Callier v. Billie E. Bauer of Oklahoma City. Here is his E. Normisly Stupid comments and suggestions.&lt;br /&gt;&lt;br /&gt;Friday, June 29, 2007&lt;br /&gt;Billie Bauer intends to file an answer&lt;br /&gt;Nothing in this post should be construed as being legal advice, it is merely my opinion. And, bear in mind, I do not know all of the facts behind the plaintiff's claims.&lt;br /&gt;&lt;br /&gt;In reading Creditwrench CEO Billie Bauer's recent posts, it appears his next step in the lawsuit filed against him is to file an answer to the complaint.&lt;br /&gt;&lt;br /&gt;That could be a procedural mis-step. There is a matter of personal jurisdiction of the court where the case was filed. By filing an answer, Creditwrench CEO Billie Bauer could essentially be waiving personal jurisdiction.&lt;br /&gt;&lt;br /&gt;I would think a better move would be a motion to dismiss for lack of personal jurisdiction under rule Rule 12(b)(2). This would shift the burden to establish personal jurisdiction of the court in the matter to the plaintiff.&lt;br /&gt;&lt;br /&gt;Jurisdictional issues involving "cyberspace" are quite complicated.&lt;br /&gt;&lt;br /&gt;I think in Creditwrench CEO Billie Bauer's favor is the court's holding in Zippo Mfg. Co. v. Zippo Dot Com, Inc., 952 F. Supp. 1119, 1124 (W. D. Pa. 1997) which in part states:&lt;br /&gt;&lt;br /&gt;At one end of the spectrum are situations where a defendant clearly does business over the Internet. If the defendant enters into contracts with residents of a foreign jurisdiction that involve the knowing and repeated transmission of computer files over the Internet, personal jurisdiction is proper. At the opposite end are situations where a defendant has simply posted information on an Internet Web site which is accessible to users in foreign jurisdictions. A passive Web site that does little more than make information available to those who are interested in it is not grounds for the exercise [of] personal jurisdiction.&lt;br /&gt;&lt;br /&gt;Then again, this is just my opinion........I might be wrong :)&lt;br /&gt;&lt;br /&gt;// posted by Creditwrench-thetruth @ 5:34 AM&lt;br /&gt;&lt;br /&gt;He's the Monkey, I'm THE WRENCH!&lt;br /&gt;&lt;br /&gt;Yes, he just might be as wrong as ever. The first and most important reason that his  suggestion is wrong is that when there is a dispute involving a federal question between parties of different states the Court in which the Plaintiff files has jurisdiction under the diversity clause. To make that point more clear, in the case mentioned the court clearly stated it had jurisdiction under the diversity clause thereby refudiating the statements of the plaintiffs about jurisdiction which were clearly wrong and also albeit unknowingly also shot down the theories of the E. Normisly Stupid&lt;br /&gt;&lt;br /&gt;He has posted a promise on his foglog that as soon as he quits laughing he will discuss the latest information on the case and why he thinks the defendant made a procedural error. Of course, it is anyone's guess as to how long it will take him to quit laughing and post something more. After all, it took him almost two weeks to quit watching the OPEN and post another obfuscation on his foglog.&lt;br /&gt;&lt;br /&gt;Another factor which clearly shows his inability to read and understand court cases is his use of the case Zippo Mfg. Co. v. Zippo Dot Com, Inc., 952 F. Supp. 1119, 1124 (W. D. Pa. 1997)&lt;/b&gt;&lt;p&gt;&lt;/p&gt;&lt;p&gt;&lt;b&gt;He stated the following&lt;br /&gt;&lt;br /&gt;I think in Creditwrench CEO Billie Bauer's favor is the court's holding in Zippo Mfg. Co. v. Zippo Dot Com, Inc., 952 F. Supp. 1119, 1124 (W. D. Pa. 1997) which in part states:&lt;/b&gt;&lt;/p&gt;&lt;p&gt;&lt;b&gt;What he fails to have read and understood is the most vital element of all in the case which is that the defendant lost miserably. Which is, of course, what he would like me to do in this situation.&lt;/b&gt;&lt;/p&gt;&lt;p&gt;&lt;b&gt;Clearly, the E.Normisly Stupid thinks I am as dumb as he is.&lt;/b&gt;&lt;/p&gt;&lt;p&gt;&lt;b&gt;Another point made by him in his E. Normis Stupidity is the following also extracted from that same court case:&lt;/b&gt;&lt;/p&gt;&lt;p&gt;&lt;b&gt;A passive Web site that does little more than make information available to those who are interested in it is not grounds for the exercise [of] personal jurisdiction.&lt;/b&gt;&lt;/p&gt;&lt;p&gt;&lt;b&gt;In Zippo the court said that information made available to those who are interested in it by a passive website is not grounds ofr exercise of personal jurisdiction.&lt;/b&gt;&lt;/p&gt;&lt;p&gt;&lt;b&gt;Passively posting information on a web site for anyone to grab and do with as they see fit is a far cry from a web site whose information is only available for a high price. And if the seller of that information provides false and misleading information to it's consumers is a very far cry from passively providing information for anyone to grab and use as they see fit.&lt;/b&gt;&lt;/p&gt;&lt;p&gt;&lt;b&gt;So exactly how was the information being sold false and misleading? The information itself was not false or misleading because buyers knew exactly what they would be getting for the money they paid. What was false and misleading was claiming that the "service" advertised was perfectly legal. So how was it not legal? The contention was and still is that it is not illegal for the purchaser to be added as an authorized user to the tradelines of people unknown and unrelated to the purchaser for the sole purpose of artificially elevating their credit scores. Well, that much is true as well, but what isn't stated is that if the purchaser uses that falsely elevated score to get credit he otherwise could not qualified for he has presented false and misleading information to a lender and that is an illegal act under federal statutes and carries a stiff penaly. So, no, it isn't illegal to be added to the tradelines of another person unknown to the purchaser. What is illegal is use of what was purchased to artifically elevate ones credit score for the purpose of obtaining new credit that one would not otherwise qualify for.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.creditwrench.com/CalliervBauer.html"&gt;All of the correct filings in Callier v. Bauer will be posted here as soon as they appear on Pacer.&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;That way you don't have to rely on the monkey to post whatever portion of the truth he wants you to know about. Normis Debtor</title><content type='html'>&lt;h1&gt;Thanks to E. Normis Debtor&lt;/h1&gt;&lt;br /&gt;&lt;br /&gt;I have noted with great interest that E. Normis Debtor has posted his suggestion that the defendant challenge the jurisdiction of the court on his blog. In the referenced case the Plaintiff has expressed great respect for E. Normis Debtor and his opinions.&lt;br /&gt;&lt;br /&gt;How the Plaintiff will react to E. Normis Debtor having made suggestions which are apparently intended to reduce the chances of the Plaintiff to prevail remains to be seen.&lt;br /&gt;&lt;br /&gt;The outcome of this case will be interesting indeed.&lt;br /&gt;&lt;br /&gt;Another interesting aspect of this ongoing lawsuit is that Robert Paisola of Western Capitol Financial and mycollector dot com has expressed an interest in being joined as a 4th plaintiff in the case. He has generously offered to pay half the costs of litigation. &lt;br /&gt;&lt;br /&gt;In the event that the current 3 platiffs should decide to accept Paisola's offer would they then be willing to give Paisola half of the expected $1,040,000 proceeds?&lt;br /&gt;It seems unlikely that they would sell a half interest in the proceeds for $125.oo but if the plaintiffs were to accept Paisola's offer that certainly would seem to be a great position for Paisola to be in. &lt;br /&gt;&lt;br /&gt;Maybe they would be more amenable if Robbie were to pay $90 for a 1/4 interest in the outcome of the suit and take the chance of walking out with $260,000 each. &lt;br /&gt;&lt;br /&gt;If the court dismisses the case for lack of jurisdiction as suggested by E. Normis Debtor then the current 3 plaintiffs would only have wasted $270. That may be something they might give some consideration due to their obvioiusly great respect for the opinions of E. Normis Debtor. If, on the other hand they let Paisola have a half interest in return for the payment of half the costs and the court dismisses the case for lack of jurisdiction, they would only be out $180.00. &lt;br /&gt;&lt;br /&gt;There is also the possibility that the court will dismiss on other grounds raised by the defendant and if that happens the defendant may decide he ought to file suit on some availably cause of action. Maybe the defendant might sue each of the current plaintiffs for $1,040,000 each. How would Paisola like that? The defendant has good reason to suspect that Paisola would not even respond to the complaint and the defendant would then be awarded judgment against Paisola for the full $1,040,000 plus costs. After all, he didn't respond to other complaints when he was sued so why would he respond to another one?&lt;br /&gt;&lt;br /&gt;Of course, the current plaintiffs and Paisola alike believe that they will be victorious but at best they only have a 50-50 chance to win. Either they will or they won't. Only time will tell which way it will go.&lt;br /&gt;&lt;br /&gt;P.S.&lt;br /&gt;&lt;br /&gt;After a week of watching the Open, E. Normis Debtor finally woke up, rushed over here to see what the latest news might be regarding this case, hunted around Paisola's blogs until he found what I was referring to and finally from deep within the bowels of his nauseous anatomy loudly emitted the following"&lt;br /&gt;&lt;br /&gt;Sunday, July 1, 2007&lt;br /&gt;More babble eminating from the pie whole of Paisola&lt;br /&gt;Recently, Western Capital CEO Robert Paisola suggested he be named a co-plaintiff in the case of Callier et al v. Creditwrench. His reasoning? He is a "similarly situated party".&lt;br /&gt;&lt;br /&gt;Where Paisola comes up with so much Crappola is beyond me.&lt;br /&gt;&lt;br /&gt;This case is not a class action, doesn't qualify as a class action, and will never be a class action.&lt;br /&gt;&lt;br /&gt;What Robert Paisola is talking about, but apparently knows nothing about, is the legal principle of permissive joinder.&lt;br /&gt;&lt;br /&gt;However, to be joined as a plaintiff in the instant case would require that Western Capital CEO Robert Paisola had a right to relief out of the same occurrance(s) alleged by the current plaintiffs that entitles them to relief. CONSUMER NOT REQUIRED TO PLEAD THAT A CRA GAVE NOTICE TO A&lt;/p&gt;&lt;p&gt;FURNISHER OF A CONTESTED ENTRY; DISCOVERY ON THIS IS ALLOWED&lt;/p&gt;&lt;p&gt;Watson v. Trans Union Credit Bureau, et al., 2005 U.S. Dist. LEXIS 7376, No. 04-205-B-C&lt;/p&gt;&lt;p&gt;(D. Me. 04/28/05).&lt;/p&gt;&lt;p&gt;FCRA imposes obligations on furnishers of information, technically speaking, only&lt;/p&gt;&lt;p&gt;after a CRA notifies them about disputed record information. The furnisher must investigate&lt;/p&gt;&lt;p&gt;the disputed information and report the results back to the CRA. A consumer can sue a&lt;/p&gt;&lt;p&gt;furnisher under FCRA for failing to fulfill its obligations; however the consumer is not&lt;/p&gt;&lt;p&gt;absolutely required to specifically allege in his complaint that the CRA properly notified the&lt;/p&gt;&lt;p&gt;furnisher about the disputed credit information. Rather, the consumer should be given an&lt;/p&gt;&lt;p&gt;opportunity to collect evidence on this point during discovery to establish this FCRA element.&lt;/p&gt;&lt;p&gt;The plaintiff Watson was victimized by identity theft. The thief obtained credit from&lt;/p&gt;&lt;p&gt;New Cingular Wireless and ran up cellular phone bills in Watson's name. After the identity&lt;/p&gt;&lt;p&gt;thief failed to pay the cellular phone bills, Cingular reported the delinquent account in&lt;/p&gt;&lt;p&gt;Watson's name to the CRAs.&lt;/p&gt;&lt;p&gt;Watson sued Cingular for violating FCRA by failing to properly investigate and to&lt;/p&gt;&lt;p&gt;correct inaccurate information on his credit report. Cingular moved to dismiss on the grounds&lt;/p&gt;&lt;p&gt;that Watson inadequately alleged a FCRA violation since Watson did not assert that Cingular&lt;/p&gt;&lt;p&gt;as the furnisher was notified by a CRA.&lt;/p&gt;&lt;p&gt;FCRA Section 1681s-2(b)(1) provides that "[a]fter receiving notice pursuant to section&lt;/p&gt;&lt;p&gt;1681i(a)(2) of a dispute with regard to the completeness or accuracy of any information&lt;/p&gt;&lt;p&gt;provided by a person to a consumer reporting agency, the person shall" take certain measures&lt;/p&gt;&lt;p&gt;to address and resolve the dispute. Cingular argued that Watson's claim should be dismissed&lt;/p&gt;&lt;p&gt;because he failed to allege that Cingular received notice from a CRA . Paisola's site contained an entry in which he soundly denounced my article and provided a link to a page on Pacifico's site that expressed great dismay at the thought that I had bashed her in my article.&lt;p&gt;&lt;br /&gt;So why did I use the term Journalistic Prostitute? The first problem that presents itself is that we need to define the term and that may indeed be a difficult task  all by itself when even such a prestigious member of the Ignorati such as E. Normis Debtor who lays claim to be all knowing about almost everything in his Quixotic blogging adventures states that frankly he is not sure what a "journalistic prostitute" is.&lt;br /&gt;&lt;br /&gt;Of course, in his quest to seek out and slay all the evil knights of credit repair  bounding about the internet while protecting the honor of his fair maiden &lt;a href="http://cchconsulting-thetruth.blogspot.com/2007/06/creditwrench-gives-best-answers.html"&gt;CCH CONSULTING,&lt;/a&gt; another illegal credit repair scam he had to take a few more pokes at Robert Paisola thus proving his similiarity to DON QUIXOTE who, according to Miguel Cervantes, rode about the ancient Spanish landscape jousting with windmills in the night trying to uphold the dignity of his fair Dulcina, a prostitute.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;Of course all of us know the definition of the word prostitute but many do not realized that a woman does not legally become a prostitute until she mentions a price she will charge for bestowing her favors upon another and usually without somehow ascertaining whether or not  that other person might have some type of social disease.&lt;/p&gt;&lt;p&gt;So now let us attempt to see what is defined by the term Journalistic Prostitute since the word prostitute is modified by the word Journalistic. Normis Debtor and his nonsense postings</title><content type='html'>&lt;h3&gt;Monday, June 11, 2007&lt;/h3&gt;            &lt;a name="6152613719845751390"&gt;&lt;/a&gt;      &lt;h2&gt; Creditwrench on replevin&lt;/h2&gt;               &lt;div align="justify"&gt;Here is some recent advice posted by Creditwrench CEO Billie Bauer to those who might be facing an action in replevin.&lt;br /&gt;&lt;br /&gt;&lt;h4&gt;"So if you are in foreclosure.....The first thing you need to do is to make as certain as possible that your home is totally secure, otherwise you too can come home to find your home stripped"&lt;/h4&gt;&lt;br /&gt;&lt;br /&gt;Absolute nonsense.&lt;br /&gt;&lt;h3&gt;Absolute nonsense is it? Since when is it absolute nonsense to make certain that your home is as secure as possible?&lt;/h3&gt;&lt;br /&gt;You can't make your home secure enough to remove it from the reach of the mortgage company if they have taken the necessary legal steps to take possession.&lt;br /&gt;&lt;h3&gt;IF, IF, IF, IF, always an IF in there, isn't there? Problem is that mortgage companies don't always take the necessary legal steps first. They have companies to whom they send lists of their homes which they are going to foreclose on. These companies are paid to watch the homes on their lists to see to it that they are not abandoned and left unattended. If they find a home that appears to have been abandoned they have orders to drill out the locks and replace them with new ones. They are also supposed to "winterize" the homes even though the daily temperatures&lt;br /&gt;are in the triple digits. They usually don't want to have to go to all the trouble of drilling out the locks if they can find an open window or door to gain entrance through but they will drill out the locks if they can't find an easier entrance point. If they can find an easy entrance point they prefer that to standing outside the home in broad daylight drilling out the locks. Causes less problems if a patrol car happens by and thinks there might be suspicious activity going on. This process of locking out the home usually isn't a problem because it normally happens when the home has truly been abandoned and is obviously vacant. But if it is done before all the legal steps have been taken then it is an illegal eviction and it happens with regularity. The E. Normis Debtor jumps to conclusions in his haste to defame yet once again. &lt;/h3&gt;&lt;br /&gt;Someone doesn't just show up with a u-haul and start moving out your furniture. That's how people get shot. They arrive with the sheriff in tow. The sheriff takes possession of the property by court order and allows the creditor to take whatever steps are necessary to enter the property.&lt;br /&gt;&lt;h3&gt;No, they don't just show up with a u-haul and start moving out your furniture. If there is any furniture in the home they just throw it out on the curb for the trash man or whoever to haul it away for them. They don't take that much time. And if the homeowner isn't there and apparently hasn't been there for at least a few days then who is going to shoot them, the neighbors?&lt;/h3&gt;&lt;br /&gt;The more "secure" you make your residence, as suggested by Creditwrench CEO Billie Bauer, the more damage will occur during their entrance. They simply drill out the locks if they can't find an open window or door and replace the locks with new ones. They are paid to clean up the property and get it ready to go on the market, not damage or destroy property. But sometimes they go too far and don't investigate enough. They are supposed to watch the property for a few days to see if there might be some activity or signs that the property is still occupied before they do their handiwork but sometimes they don't.&lt;/h3&gt;&lt;br /&gt;Your state statutes clearly define what steps a creditor must take in an action in replevin, or repossession of real property.&lt;br /&gt;&lt;br /&gt;In most states, a creditor must post a bond with the court in an amount equal to or greater than the value of the property they are seeking to take possession of.&lt;br /&gt;&lt;br /&gt;If it is later adjudged that their taking possession of the property was not in accordance with local laws, that bond is used to compensate the homeowner for any damages. And statutory damages can run as high as double the value of the property.&lt;br /&gt;&lt;br /&gt;So contrary to Creditwrench CEO Billie Bauers false and misleading advice, the first thing you should do when faced with a foreclosure action is to consult legal counsel to ensure your legal rights are protected.&lt;/div&gt;&lt;h3&gt;OH sure Normie. More of your useless advice. Useless because most people in foreclosure don't have the funds to pay for competent legal counsel even if one was available. There are no attorneys in Oklahoma willing to take on such cases. I do know of one who claims he will do that but the only way he will is if he thinks he can file a big lawsuit on the creditors for some violation of law. Then he makes the homeowner sign a contract which stipulates that if he files a lawsuit and wins he gets 60% of the take and they get the rest after costs. Problem is that if you check his public record you will find that he has never filed a lawsuit against any creditor in any court. Like you, Mr. E. Normis Debtor, he is nothing but a scam. Normie claims that the creditor has to put up a bond to foreclose on a home that is equal to the value of the home or greater. Not in Oklahoma they don't! And in fact, the creditor is seldom the plaintiff at all in a foreclosure action. The plaintiff is usually some other entity such as Mortgage Electornic Registry Systems acting on behalf of the creditor. She claims that Creditwrench and it's methods are no good and in some cases such as the westcap endorsement for tradeline removal after payment claims she can't even understand what it will do.&lt;/p&gt;&lt;p&gt;She claims to have much better methods to fix credit but let's see how good she is at fending off debt collection phone calls compared to the creditwrench method to be found at &lt;a href="http://www.creditwrench.com/18questions.html"&gt;18questions.html&lt;/a&gt;&lt;/p&gt;&lt;p&gt;&lt;br /&gt;She put up two recordings on a new web site of her talking to a debt collector. &lt;a href="http://www.creditwrench.com/ChristineBaker.mp3"&gt;Christine Baker live talking to a debt collector&lt;/a&gt;&lt;/p&gt;&lt;p&gt;She put the two files up in .WAV format so if you just click on them all you get is a bunch of gibberish. In order to actually get them in audible format you have to copy the url and pasted it into Windows Media Player. I did that and saved each of the two little files then converted them to .mp3 files so  all you have to do is click on them and listen to them if you have Quicktime.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;Her two original files are to be found &lt;a href="http://fight-back.us/forum/index.php?s=225a41cfda57f078bbac2d0970a966ef&amp;amp;showtopic=1171"&gt;here. &lt;/a&gt; so that you can check them to be sure that they are exactly the same with no editing in case you choose not to take my word for it.&lt;/p&gt;&lt;p&gt;It quickly becomes obvious that Christine Baker don't even know how to deal with a debt collector let alone help anybody else. She needs to stop criticizing Creditwrench and get herself a copy. Watch his latest attempt to leap tall buildings.&lt;/p&gt;&lt;p&gt;On his blog falsely named CREDITWRENCH-THETRUTH He provided the following obviously false and misleading information.&lt;/p&gt;&lt;p&gt;Tuesday, June 05, 2007&lt;br /&gt;Latest false and misleading information&lt;br /&gt;Creditwrench CEO Billie Bauer seems to be a cornicopia of false and misleading information.&lt;br /&gt;&lt;br /&gt;His latest disemination of false and misleading information once again concerns this authors identity. Which, by the way, is readily available on the internet to anyone who would bother to search. Go ahead, try it.&lt;br /&gt;&lt;br /&gt;Now he has me confused with a company called CCH Consulting.&lt;br /&gt;&lt;br /&gt;However it seems Western Capital CEO Robert Paisola gets his location information from Billie's blog. Apparently after reading Billie's blog, he called CCH Consulting to ask some very "direct" questions as to whether or not they are me. They are not me, nor am I them.&lt;/p&gt;&lt;br /&gt;&lt;br /&gt;The first clue to the E. Normity of this blatant prevarication is that if he isn't Brandon L. Callier then how would he know that Robert Paisola had called Callier to ask such questions as claimed? Obviously he wouldn't have any such knowledge as claimed unless he either is Callier or a close business partner or friend or relative and knows Callier well. If he isn't Callier then Callier had to have related the fact of Paisola's call to E. Normis. E. Normis suggests that we do an internet search to find out who he is and that he is readily available. After untold numbers of searches over a period of many months using every search technique on a great many search engines no clue as to who E. Normis is has ever turned up except those that link him to CCH Consulting. His suggestion is nothing more than an exercise in futility. He would obviously not want us to search for Creditwrench-thetruth because that would reveal far too much about what he is but nothing about who he is. Maybe we should search for nobody because for all practical purposes that is what he is. Nobody. He sure would like you to believe he is somebody but is only a blowhard scared of his own shadow. As this author has always said, if they won't post their true name, address and phone number then you can't believe what they say or trust them as far as you can throw them. E. Normis Debtor is no exception.&lt;br /&gt;&lt;br /&gt;So which is it?&lt;br /&gt;&lt;br /&gt;&lt;li&gt;E. Normis is actually Callier of CCH Consulting&lt;/li&gt;&lt;br /&gt;&lt;li&gt;E. Normis is a close business partner of Callier&lt;/li&gt;&lt;br /&gt;&lt;li&gt;E. Normis is a friend of Callier&lt;/li&gt;&lt;br /&gt;&lt;li&gt;E. Normis is a relative of Callier&lt;/li&gt;&lt;p&gt;&lt;/p&gt;&lt;p&gt;So let's take the first assumption as the correct one and see where that leads us. We will start our search on &lt;a href="http://www.technorati.com/"&gt;Technorati.com&lt;/a&gt; which is most certainly one of the best blog search engines out there since they are now owned by GOOGLE. Neither     Technorati nor the GOOGLE blog search turns up any solid clue as to whether or not E. Normis is or is not Brandon Callier or vice versa so as usual, the suggestion by E. Normis is nothing short of false and misleading.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;So let's go to Brandon's web site to look for some clues. After all, going directly to the horse's mouth is usually not a bad idea at all. So what do we find there to give us a clue? Let us see. The first clue is to be found on his home page. There we find a link to Brandon's blog at angryconsumer.blogspot.com and when we click on that link we find a  plane jane blog which is a carbon copy of all of the blogs claimed by E. Normis. All of them are as alike as peas in a pod.&lt;/p&gt;&lt;p&gt;He refers to a posting he made on the old pcmholdings message board wherein I first exposed the unethical tactics of his CCH consulting company. He just about jumped out of his skin defending CCH Consulting  but why would he do that if he were not somehow related to or owned it? He offered absolutely no reasonable explanation for his outrage except that it was somehow legal to buy seasoned tradelines to boost your credit scores. While it may or may not be illegal, it is most definitely unethical and some authors are now beginning to claim that doing so is actually a fraud. Although at the time, his outrage at my disclosure of the scam might have seemed reasonable to some there was absolutely nothing other than actual ownership of the company in question that would have elicited such a vehement response from a disinterested person.&lt;/p&gt;&lt;p&gt;It is highly unlikely that E. Normis will ever tell the whole truth anywhere nor ever do or say anything that will actually reveal his true identity there is far more than enough evidence to leave little or no doubt that E. Normis and Callier are one and the same. E. Normis Debtor is a master of prevarication, false and misleading information and innuendoes so why is there any reason to believe him now? IF he isn't Callier then let him come forth with some concrete and conclusive evidence or forever stand convicted.&lt;/p&gt;&lt;p&gt;In any case, Callier and CCH consulting has been selling authorized user tradelines to people's credit reports at highly inflated prices and demanding all their personal infomation in the process.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;&lt;a href="http://www.technorati.com/tag/E.+Normis+Debtor" rel="tag"&gt;E. Paisola, wearing an ever-ready smile, sat at a large round table, waiting. &lt;/p&gt; &lt;p&gt;Actually, the world of felon and alleged Internet cyberpirate Robert Paisola can be downright creepy. It seems the Internet—more so than patriotism—has become the last refuge of scoundrels. &lt;/p&gt; &lt;p&gt;I promised the manager of the building where Paisola and I met not to reveal the property’s name and address. She didn’t want to be associated with 39-year-old Paisola in print, especially after learning he claimed it as one of his offices. Nor did a self-described friend of his at the complex, who held up his hands at the mention of Paisola and walked away. One of Paisola’s relatives even begged via e-mail that his family not be brought into any story. &lt;/p&gt;  &lt;p&gt;Paisola, however, wanted to talk—at least for our first and last interview. “I want front page,” he chanted. &lt;/p&gt;  &lt;p&gt;So, for two and a half hours, we battled over the truth about Paisola, founder and Chief Executive Officer of a mysterious Utah company, Western Capital Group. &lt;/p&gt;  &lt;p&gt;While Western Capital Financial, Inc. is a state-registered corporation, whether or not the company actually has offices or employees beyond Paisola and the Lehi condo he rents from a relative is debatable at best. Paisola’s court-documented criminal past, which includes convictions for insurance fraud, child pornography possession and false loan applications, is not. &lt;/p&gt;  &lt;p&gt;Paisola considers the past behind him. “I simply draw a line and move forward,” he said. “That’s the way I am able to create what I create, the abundance in my life. I do so by being able to simply say, ‘That was then, and I’ve paid my price to society for the things I have done.’”&lt;/p&gt;  &lt;p&gt;But, if such abundance exists, critics argue, it may come in part from Paisola soliciting fees on the Internet from people being pursued by debt collectors. He professes to be an expert on debt collection on his Website MyCollector.com, but doesn’t reveal that law enforcement agents shut down his first collection agency, and he went to jail for submitting a false loan application.&lt;/p&gt;  &lt;p&gt;Which perfectly illustrates the true wonder of Paisola’s world: It’s built on an electronic version of the street-corner hustle, Three Card Monte. Apparently with plenty of time on his hands, Paisola endlessly shuffles and multiplies Web pages so you never know where the truth is hiding—or if it’s present at all. &lt;/p&gt;  &lt;p&gt;Take Robert Paisola's Western Capitol Foundation. Its Web page says it promotes “criminal offender reform.” MSNBC even featured him as a prisoners' rights advocate in a news segment in February. Yet Paisola can’t cite a single prison he’s visited as an advocate or an ex-con he’s helped. &lt;/p&gt;  &lt;p&gt;His publicist says he “is quickly becoming one of America’s eminent citizens, motivational speakers and success-training leaders.” But he would not provide a couple of clients to testify to the virtues of his programs.&lt;/p&gt;  &lt;p&gt;Add to all this relentless puffery his pressuring of companies large and small with innuendo-strewn blogs and Websites and the overwhelming impression is of a man hiding his past from prying eyes with endless digital sleights of hand—even as he claws at your wallet. &lt;/p&gt;  &lt;p&gt; Consider this a cautionary tale: Robert Paisola would like nothing better than to pull you into one of many scams, burrow under your skin and stay there.&lt;/p&gt;&lt;p&gt;You will not want to miss reading the whole story because there is a lot more there than this brief synopsis.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.slweekly.com/article.cfm/conmancom"&gt;The full story from the Salt Lake Weekly Newspaper&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;And now that it is in public print by a reputable newspaper that now brings us back to the endorsements of Paisola by Patti Pacifico. In a recent post to his westerncapital-thetruth blog E. Normis made the following comment.&lt;br /&gt;&lt;p&gt;5/19/2007&lt;br /&gt;Recently, Western Capital CEO Robert Paisola advised an unwary consumer that, because he didn't have a series of "written agreements" with a former girlfriend to repay the money he lent her, he was "screwed". Here is Western Capital CEO Robert Paisola's exact statement: "If you loaned a former girlfriend a substantial sum "Over The Years" I seriously doubt that you have a series of written agreements with her for the loans. Based on this fact, you are screwed." The above comment by Western Capital CEO Robert Paisola is a prime example of why he is unqualified to offer advice on such matters. If one person loans another money, and the party accepting the money agrees to repay it, a contract is formed. Providing the terms of the loan are legal, the contract is enforceable in a court of law and need not be in writing.&lt;/p&gt;&lt;br /&gt;&lt;p&gt;&lt;br /&gt;Of course, based on the E. Normis amount of email I receive, it would appear not many people are putting faith in any advice being given by Western Capital CEO Robert Paisola. Just do a google search combining the phrases "Robert Paisola" and "Western Capital" and you'll see why Uncle Normie gets so much email at unclenormie@oklahomacity.usa.com about Western Capital CEO Robert Paisola. So much for Western Capital CEO Robert Paisola's google "webmaster controls" that he threatened Uncle Normie with.&lt;/p&gt;&lt;br /&gt;The comical part of the E. Normis post is that he always believes that everyone will automatically enter the exact search terms into google that he thinks they should. The problem is that people never do that! Most people surfing the net enter search terms very different from what bloggers and webmasters believe they will enter. &lt;br /&gt;&lt;br /&gt;That is because webmasters and bloggers usually have an E. Normis ego. If they are trying to sell Grady County Buffalo Chips their ego leads them to believe that everybody will be hunting for their product or service. That simply isn't the case.&lt;br /&gt;&lt;br /&gt;An E. Normis ego leads Normie to falsely misinform his readers that he gets large amounts of email and his blog has an E. Normis following which is, of course, far from the truth. &lt;br /&gt;&lt;br /&gt;The same is true of his opponent, Robert Paisola. Paisola's Enormis imagination leads &lt;br /&gt;him to believe that all of the bad publicity he himself has fathered by his criminal actions is the cause of his failure to acquire new suckers for his nefarious business practices. Of course, nothing could be further from the truth because nobody searches for Robert Paisola nor any of his congregation of false business names. &lt;br /&gt;&lt;br /&gt;What these two clowns need to learn is how to position one's self in search engines using search terms that large numbers of people are searching for constantly.
